Resolving disputes
The arbitration agreement and the class, collective and representative waiver in this section apply to you only if you have ticked a box agreeing to these terms on one of NSI’s forms. Browsing this website alone does not create an agreement to arbitrate. Despite the “Changes to these terms” section below, the version of this section that applies to you is the one dated on the form where you ticked the box, and a later version applies to you only if you tick the box again on a form showing its date, and never to a dispute that arose before you ticked it.
If you and NSI cannot resolve a dispute about this website or these terms informally, the dispute will be settled by final, binding arbitration under the Federal Arbitration Act, before a single neutral arbitrator administered by the American Arbitration Association under its Commercial Arbitration Rules, or by another service both parties choose, held by video or in the county where you are based unless both parties agree otherwise. Judgment on the award may be entered in any court with jurisdiction.
Claims may be brought only on an individual basis, not as a plaintiff or class member in any class, collective or representative proceeding, and the arbitrator may not combine more than one person’s claims unless both parties agree.
Nothing in these terms waives the right to seek public injunctive relief under California law. A claim for public injunctive relief will be decided by a court, not an arbitrator, and the court will pause that claim until any claims that are subject to arbitration have been decided.
If a court finally determines that the class, collective and representative waiver above cannot be enforced for a particular claim, that claim alone will go ahead in court rather than in arbitration, the court will pause that claim until the arbitration of every other claim is complete, and the rest of this section will still apply to every other claim.
Governing law and courts
California law governs these terms. Any dispute that is not subject to arbitration under these terms will be heard only in the state or federal courts located in California, and you and NSI agree to those courts’ jurisdiction.
Ending access
NSI may suspend or end your access to this website at any time, without notice.
Changes to these terms
When we change these terms, we will post the new version on this page and update the “Last updated” date at the top. The version posted when you use the website is the one that applies, except that a change does not apply to a dispute that arose before the change was posted.
General
These terms are the whole agreement between you and NSI about this website. If any part of them cannot be enforced, the rest still applies. Using this website does not create any partnership, joint venture, employment or agency relationship between you and NSI.
